Night shift jobs in India: your rights under the labour codes

LiveRec EditorialUpdated

A night shift job in India is work done in the late evening and overnight hours, common in support centers, logistics, hospitals and security. The OSH Code sets a daily limit of eight hours, pays overtime at twice the wage rate with the worker's consent, and requires women's consent for work after 7 p.m. and before 6 a.m.

At a glance

  • The OSH Code, 2020 limits work to eight hours a day, with intervals and spread-overs notified by the appropriate government.
  • Overtime is paid at twice the rate of wages, and the worker must consent to overtime.
  • A shift that runs past midnight has its own rule for the weekly holiday and for counting hours.
  • Women may work at night with their consent and the safety conditions the government prescribes.

What does the OSH Code say about hours?

Section 25 says no worker may be required or allowed to work for more than eight hours in a day, and the period of work each day must fit within the intervals and spread-overs notified by the appropriate government. Which government applies, central or state, depends on the employer. Our guide to working hours and overtime covers the weekly limit.

How is overtime paid?

Section 27 says overtime work must be paid at twice the rate of wages, and the proviso says a worker is required to work overtime only with the worker's consent. The appropriate government may also set the total number of overtime hours. If you work extra at night, ask that the hours be recorded on the roster and the payslip.

What is special about a shift past midnight?

Section 28 of the OSH Code covers a shift that extends beyond midnight. For such a worker, the weekly holiday for a whole day means 24 consecutive hours beginning when the shift ends. The hours worked after midnight are counted in the previous day. This rule stops a night worker from losing rest because of the date change.

Can women work night shifts?

Yes, with conditions. Section 43 says women may be employed before 6 a.m. and beyond 7 p.m. with their consent, subject to conditions on safety, holidays and working hours that the appropriate government prescribes. Ask the employer what safety measures it provides, such as transport. For more, read jobs for women in India.

Read OSH Code basics, and use how to verify an employer before you accept.

What if my employer breaks these rules?

Start by raising it in writing with the employer and keep a record of your hours. State labour departments handle complaints in their areas. The Ministry of Labour and Employment's site (labour.gov.in) lists its services. Rules differ by state, so also check your state's notified rules.

How do I avoid fake night shift offers?

Be careful about night "work from home" jobs that ask for a registration fee or your OTP, and about messages that push you to a chat app. Read work from home jobs and fake job offers. If money is lost, call 1930 and report at cybercrime.gov.in.
