F-1 to H-1B for Indian students

Indian students on F-1 usually work on OPT, then an employer registers them for the H-1B. A US master's degree or higher gives access to an extra 20,000 cap numbers. If a cap-subject petition is filed on time and requests a change of status, the cap-gap rule can extend your F-1 status and OPT until 1 April.

What is the usual path?

  1. Study on F-1; ask your Designated School Official about OPT and STEM OPT.
  2. Work on OPT, and STEM OPT if eligible.
  3. The employer registers you in March; if selected, files the H-1B petition.
  4. Cap-gap may bridge the time until 1 October.

What if I am not selected?

STEM OPT may give further tries. Other options: cap-exempt employers, O-1 or L-1.

What does it cost?

LiveRec quotes no government fees. Check the USCIS fee schedule.

What changed for the FY 2027 H-1B cap?

USCIS says that starting in fiscal year (FY) 2027 it uses a weighted selection process. When random selection is required, registrations are generally weighted by the highest Occupational Employment and Wage Statistics (OEWS) wage level the offered wage equals or exceeds for the job's Standard Occupational Classification code and area. A wage level IV registration enters the pool 4 times, level III 3 times, level II 2 times and level I once. Each beneficiary still counts once toward the numerical allocation. Ask the employer which wage level it will register. See H-1B lottery odds.

How does the filing calendar work?

StepWhat USCIS says
RegistrationEmployers register each prospective beneficiary electronically before filing a cap-subject petition
FilingA cap-subject petition needs a valid, selected registration. USCIS accepts online filing for selected registrations starting April 1
Start dateThe petition must request a start date of October 1 or later of the fiscal year
Master's capAn additional 20,000 petitions for people with a master's degree or higher from a US institution of higher education are exempt from the regular 65,000 cap

How does cap-gap work in SEVIS?

The Student and Exchange Visitor Program says SEVIS will automatically extend post-completion OPT or the STEM extension if three things are true: on or after April 1 an employer files an eligible H-1B petition to change your status, the requested H-1B start date is October 1, and your OPT ends on or after April 1. USCIS says that if you have a timely filed H-1B petition with a change of status request and your F-1 status and work authorization would expire before the change of status (typically October 1), you may be eligible for the cap-gap extension.

Step by step for an F-1 student

  1. Ask your DSO what OPT and STEM OPT dates you hold, and when they end.
  2. During interviews, ask whether the company will register you for the H-1B in March and which wage level it expects. See how to ask for sponsorship.
  3. If selected, confirm the filing date with the employer's attorney so the petition is filed on or after April 1 and requests a change of status.
  4. Tell your DSO when the petition is filed so they can update SEVIS.
  5. Keep your I-20, EAD, pay stubs and the H-1B receipt notice together.

Common mistakes

  • Assuming a master's degree from India counts for the extra 20,000. USCIS says it is for a degree from a US institution of higher education.
  • Not checking that your OPT end date is on or after April 1 before relying on the cap-gap extension.
  • Letting unemployment days run while waiting for the registration. See OPT unemployment rules.

FAQ

Does cap-gap apply if my petition is filed late? No; conditions apply. See the OPT guide.

Is the master's cap for Indian degrees? No; it is for a US master's or higher.

Does the employer pay the H-1B filing costs? LiveRec states no amounts. Read the USCIS fee schedule and ask the employer. You should not be asked to pay for a registration.

What if I leave the US while waiting? Ask your DSO and the employer's attorney first. LiveRec does not give travel advice.

When is the next registration? USCIS announces the dates each year on its H-1B cap season page.
