H-1B cap-exempt employers: who qualifies

LiveRec EditorialUpdated

A cap-exempt H-1B employer is one whose H-1B petitions do not count against the annual limit. Per USCIS, that covers institutions of higher education, nonprofits related to or affiliated with them, and nonprofit or governmental research organisations. They can file at any time of year and skip the lottery.

Which employers can be cap-exempt?

  • An institution of higher education.
  • A nonprofit entity related to or affiliated with an institution of higher education.
  • A nonprofit research organisation or a governmental research organisation.

The exemption turns on the employer's own status, and USCIS looks at the facts of the relationship or affiliation. Do not assume a hospital, think tank or company qualifies; ask the employer and, where it matters, a licensed attorney. USCIS explains the "related or affiliated" test on its cap exemptions page.

When can they file?

At any time of year, without registration or selection. The rest of the process (LCA, Form I-129) is the same as in the H-1B guide.

Does cap-exempt stay cap-exempt?

Cap-exempt status belongs to the job and employer. If you later move to a cap-subject employer, that case may need a cap number. Ask an attorney; LiveRec has not confirmed the rule for people already counted against the cap.

How do I find cap-exempt roles on LiveRec?

Roles are tagged "H-1B (cap-exempt)" only when the employer says so when posting. We show what the employer told us. See sponsor jobs.

What does USCIS say about the exemption?

USCIS says H-1B workers who are petitioned for or employed at an institution of higher education or its affiliated or related nonprofit entities, a nonprofit research organization or a government research organization are not subject to the numerical cap. Separately, an additional 20,000 petitions each year for people with a master's degree or higher from a US institution of higher education are exempt from the regular 65,000 cap. Those two are different routes and the second one still needs a registration and selection.

Table: cap-exempt vs cap-subject

Cap-exempt employerCap-subject employer
Registration in MarchNoYes, an electronic registration for each beneficiary
When can it fileAny timeAfter selection, from April 1, with an October 1 or later start
After you leaveA new cap-subject employer needs a registration and selectionAnother cap-subject employer can file without a new selection if you were counted

How do I keep both?

USCIS says if you are in a cap-exempt job, you may work concurrently in a cap-subject job as long as you continue the cap-exempt job, and you may begin the concurrent job when the new employer properly files a non-frivolous Form I-129 or on the requested start date, whichever is later. As long as you stay in the cap-exempt job, were previously counted toward the cap, or are otherwise cap exempt, you will not become subject to the cap again during that time.

Step by step to find a cap-exempt role

  1. Make a list of universities, university-affiliated nonprofits, nonprofit research organizations and government research organizations in your field.
  2. Search their careers pages and LiveRec jobs with sponsorship shown.
  3. Ask HR whether the employer files its H-1B petitions as cap-exempt, and under which basis.
  4. Ask for the LCA wage and the job's degree requirement in writing.

Common mistakes

  • Assuming any hospital or company with a university partnership qualifies.
  • Forgetting that moving from a cap-exempt employer to a cap-subject one triggers the registration step. USCIS says the new employer's petition is then subject to the cap.
  • Treating a university job as a guarantee of a green card.

A note on one linked page

The older USCIS page on exemptions based on relation or affiliation, linked above, carries a note that it is archived and out of date, dated 2011. Do not rely on it; ask the employer's attorney for the current test.

FAQ

Do cap-exempt employers pay lower fees? Fee rules depend on the form and employer type. Check the USCIS fee schedule.

Is a university job easier to get? Not necessarily. The visa path is simpler; the hiring process is not.

Does the $100,000 payment apply to cap-exempt cases? See the dated status in the H-1B guide.

Can a cap-exempt employer still need an LCA? Yes. USCIS says specialty occupation petitions include a certified LCA from DOL.

Is a staffing firm at a university cap-exempt? The exemption depends on the petitioning employer's own status. Ask an attorney.

Does a cap-exempt job let me skip the lottery for life? No. See the table.

Next step: Search roles that show H-1B (cap-exempt).
