What are the rules on a probation period in India?
A probation period in India is a trial period at the start of employment whose length, notice and confirmation steps come mainly from the appointment letter, the employer's policy and, in larger industrial establishments, standing orders. The Ministry of Labour's Labour Codes handbook for employers sets no single probation length for all employers.
Indian central rules as of 31 October 2026. State rules and your own documents can differ. This is general information, not legal advice.
At a glance
- No central probation length: the Ministry's handbook for employers under the four Labour Codes does not prescribe one.
- Contract first: the appointment letter should state the probation length, the notice during probation and the confirmation process.
- Standing orders: they apply to industrial establishments with 300 or more workers, and the Central Government notifies Model Standing Orders.
- Labour Codes in force since 21 November 2025, so dated rules from older Acts may have been replaced. Check the current text.
Is probation a legal requirement?
No. Nothing in the Ministry's handbook obliges you to run a probation period or fixes how long it lasts. It is a contractual device that employers and employees agree. Any length you choose is a contract term, so state it, and any extension right, clearly in the letter.
Where the rules actually come from
- The appointment letter. The OSH Code duties in the Ministry handbook include issuing an appointment letter to all employees. Put the probation terms in it. See appointment letters under the Labour Codes and the appointment letter template.
- Standing orders. For industrial establishments with 300 or more workers, standing orders under the Industrial Relations Code define conditions of employment. Employers may adopt the Model Standing Orders and inform the Certifying Officer. Read the model text for how it treats probationers. See what standing orders are.
- Company policy. HR manuals can add detail, but they cannot cut below what the law or your letter promises.
- State law. Your state Shops and Establishments Act may add rules on service conditions. See Shops and Establishments registration.
Do probationers have legal protections?
Yes. Probation changes your contract rights, not statutory ones. The Labour Codes cover the employee from joining:
- Wages must be paid on time, and when an employee leaves by resignation, dismissal or termination, all due wages must be paid within two working days (Code on Wages, as summarized by the Ministry). See full and final settlement.
- Social security and safety rules apply according to each Code's own coverage tests, not according to whether the person is confirmed.
- Workplace harassment rules apply from day one. See the POSH Act for employers.
Take advice before ending anyone's employment, and read termination and retrenchment under the Labour Codes.
Confirming, extending or ending probation
| Outcome | What to do |
|---|---|
| Confirm | Issue a written confirmation letter before the probation end date. Update the HR record and any benefit eligibility. |
| Extend | Use only if the appointment letter allows it. Give the reason and the new date in writing before the original end date. |
| End | Follow the notice stated in your letter. Document the performance review. Settle dues within the statutory time. |
Say in the letter what happens if the end date passes without a decision: either confirmation is automatic or it needs a written letter. Pick one rule and write it down.
Notice during probation
The handbook does not fix a probation notice period. Set it in the letter, for example a shorter notice than for confirmed staff, and apply it to both sides. See the notice period policy template.
A short employer checklist
- State the probation length, extension right and notice in the appointment letter.
- Set review points at one and two months, and record them.
- Decide in advance who confirms and by when.
- Keep benefits and leave rules consistent with your policy and the law.
- Re-check the clauses when your state or the Centre notifies new rules.

FAQ
What is the maximum probation period in India? No central maximum appears in the Ministry's Labour Codes handbook. Your contract or standing orders decide.
Can I terminate during probation without notice? Only if your letter says so and the law allows it. Take advice before dismissing anyone.
Is a confirmation letter mandatory? The Labour Codes do not require one by name, but it is the clearest proof of status. Issue it.
Does probation count toward gratuity service? Check the Code on Social Security rules and your letter. See payroll compliance.
Can probation be extended? Yes, if the appointment letter permits it. Give written notice before the end date.
