How do I read background check results and adverse action?

LiveRec EditorialUpdated

US federal rules as of 30 Oct 2026.

Open the background check results from the candidate's Verification tab. Each part shows Clear or Consider; Consider means a person should review it, not that there is a problem, and the whole check then reads Needs review. Results usually arrive within 1 to 3 business days, as the order screen says. Follow LiveRec's adverse action steps if you decline.

Steps

  1. Open the candidate, then the Verification tab (or open Background checks in the left-hand menu).
  2. Read each part of the completed check. Choose Download PDF for a copy.
  3. If you are happy to go ahead, choose Proceed with candidate. The check is marked Cleared to proceed.
  4. If you decide not to hire because of the report, choose Start adverse action. A pre-adverse notice goes to the candidate, who has 7 business days to respond. After the waiting period, choose Send final adverse action notice. Only a company owner or admin can do this.
  5. If consent is still pending, choose Send reminder.

Good to know

  • The check cannot start until the candidate consents. A request expires after 7 days with no response, and nothing is billed.
  • If the candidate disputes the report, adverse action pauses while the dispute is open.
  • Adverse action means notifying the candidate and giving a chance to respond. In LiveRec, choose Send pre-adverse notice: the provider sends the candidate the notice, a copy of the report and the CFPB summary of rights, then the final notice automatically after the waiting period (7 business days) unless you proceed first or they dispute. The law is 15 U.S.C. 1681b(b)(3) and 1681m.
