What does the Protector of Emigrants do?

LiveRec EditorialUpdated

India focus: Protector of Emigrants. Checked against official Indian government pages on 30 October 2026. Where official pages disagree, this page says so.

The Protector of Emigrants (POE) is an Indian government officer under the Ministry of External Affairs who grants emigration clearance to ECR workers and enforces the Emigration Act, 1983 locally. The Protector General of Emigrants (PGE) sits above the POE offices and registers recruiting agents.

What does the law say?

The MEA overview explains that the Emigration Act, 1983 regulates emigration of ECR passport holders. Under Section 10, no person or agency may work as a recruiting agent without a valid certificate from the registering authority. The Joint Secretary (Overseas Employment) and PGE is that authority and enforces the Act with the help of POE offices.

Where are the POE offices?

The MEA lists 16 offices: Mumbai, Chennai, Delhi, Kolkata, Chandigarh, Hyderabad, Cochin, Thiruvananthapuram, Jaipur, Lucknow, Patna, Bengaluru, Guwahati, Ranchi, Bhubaneswar and Agartala. The overview says an office in Ahmedabad is under discussion with the Gujarat government. Check eMigrate for the current list.

When should I contact a POE?

  • To get emigration clearance as an individual.
  • To confirm that an agent's certificate is valid and active.
  • To lodge a complaint about an agent or foreign employer.
  • When a contract looks wrong or lower than the minimum wage fixed for your category.

What happens after a complaint?

The MEA says that for workers recruited through a registered agent, a show-cause notice goes to the agent, who must settle the complaint or risk losing the registration certificate. Complaints about illegal recruitment are referred to the state police. The MEA reported 3505 illegal agents notified on eMigrate as of 9 April 2026.

Where else can I get help?

The Pravasi Bhartiya Sahayata Kendra helpline is 1800 11 3090, with six regional centers at Delhi, Lucknow, Hyderabad, Chennai, Patna and Kochi for walk-in help, in coordination with the local POE.

What to bring to a POE office

Staff check your application and supporting documents. Based on the MEA FAQ, bring:

  • Your passport, valid for at least six months, with the visa.
  • The employment contract.
  • Proof of the fee paid by challan.
  • Your PBBY policy details.
  • If you were recruited by an agent, the agent's name and your case number.

Step by step: making a complaint

  1. Write down what happened with dates, names, phone numbers and amounts. Keep receipts, chats and the contract.
  2. Log the complaint on eMigrate, or send the details to the Protector General of Emigrants, as the MEA FAQ says. You can also call the helpline at 1800 11 3090.
  3. Note the complaint number.
  4. The MEA overview says that when a registered agent is involved, a show-cause notice is served and the agent is directed to resolve the complaint, failing which the registration certificate can be revoked.
  5. For illegal agents and trafficking, the matter is referred to the state police, and the MEA says it has issued a standard operating procedure for state governments on complaints against fake agencies.
  6. If you are already abroad, report unpaid wages to the nearest Indian mission.

Which office?

The count differs by document. The MEA FAQ (February 2024) lists 10 POE offices. The MEA overview of April 2026 says 16 offices, in Mumbai, Chennai, Delhi, Kolkata, Chandigarh, Hyderabad, Cochin, Thiruvananthapuram, Jaipur, Lucknow, Patna, Bengaluru, Guwahati, Ranchi, Bhubaneswar and Agartala. Use the newer list, and check the MEA page that gives the address and jurisdiction of each office.

Common mistakes

  • Going to the wrong office. Each has a jurisdiction.
  • Complaining only on social media. Use the official channels so the complaint is on record.
  • Waiting until you have paid more. Report early.
