EB-2 NIW from India: national interest waiver
US federal rules as of 31 October 2026. Sources re-checked against official pages on 30 October 2026. Where a figure could not be confirmed, this page links the official source instead of stating it.
The EB-2 NIW from India uses the national interest waiver (NIW), part of EB-2. It lets some applicants skip the job offer and the labor certification, and in these cases you may file the petition yourself. Indian-born applicants still wait for their priority date under the per-country limits, so NIW can remove the employer step but not the queue.
What does USCIS require?
USCIS says you must first qualify for EB-2, as an advanced degree professional or a person of exceptional ability. For the waiver, you show three things:
- The proposed endeavor has substantial merit and national importance.
- You are well positioned to advance it.
- On balance, waiving the job offer and labor certification benefits the United States.
Form I-140 is filed by a US employer in most EB-2 cases. In NIW cases, you may self-petition. Spouses and unmarried children under 21 may apply as dependants.
What does it mean for Indians?
- No employer is needed to file, which helps people on an employer-dependent status. It does not give a work permit by itself.
- The priority date for a waiver case is set differently from a labor certification case; see the priority date definition and read the Visa Bulletin.
- Evidence is the whole case: publications, recognition, and a clear plan. Read the existing EB-2 NIW guide.
Cautions
- Approval rates and processing times change. LiveRec states none.
- Paid "NIW packages" that guarantee results are a warning sign. See avoiding immigration scams.
- A licensed immigration attorney can judge whether your endeavor meets the three prongs.
What does the USCIS filing guidance say about each prong?
USCIS says a petition built around these issues, in this order, helps adjudicators find the evidence:
- Substantial merit and national importance. Describe the specific endeavor, not just the occupation. USCIS says benefits to one employer alone are not enough, and general statements about a profession's importance do not establish national importance.
- Well positioned to advance it. Show your education, skills, knowledge and record of success, any detailed plan, how you intend to pursue the endeavor, and any interest or support from customers, users or investors. Letters from experts with first-hand knowledge are more persuasive when backed by independent evidence.
- On balance, waiving the job offer benefits the US. Explain why a labor certification would be impractical, what benefits the US gets even if other US workers were available, and any urgency. USCIS says a national shortage in the occupation does not satisfy this prong by itself.
What do I need before the waiver?
USCIS says you must first qualify for EB-2 as an advanced degree professional or a person of exceptional ability. An advanced degree is a degree above a bachelor's, or a bachelor's plus at least 5 years of progressive experience in the specialty. Exceptional ability needs at least 3 of 6 criteria and expertise significantly above the ordinary. A degree from an Indian university can count if it is a foreign equivalent; your attorney will advise on an equivalency evaluation.
What does an Indian-born applicant need to know about the queue?
USCIS says that when a category does not require a DOL labor certification, the priority date is the date USCIS accepts Form I-140. Employment-based visas are limited to 140,000 a year in general, with per-country limits. So the NIW changes who files, not the queue. Read the Visa Bulletin guide and the backlog guide.
Step by step
- List the specific projects and the field you want to advance, with dates.
- Gather degrees, transcripts, equivalency evaluation, and employer letters for the 5 years of experience if you rely on them.
- Gather independent evidence, such as publications, citations, patents, funding or user adoption, where you have them.
- Prepare Form I-140 with your evidence and file it with USCIS. This petition does not include a labor certification.
- Keep your current status valid while you wait.
Common mistakes
- Using one job description as the endeavor.
- Counting experience gained before the degree. USCIS says qualifying post-bachelor's experience must come after the degree.
- Using a template. USCIS says there is no single piece of evidence that decides a case.
FAQ
Can I file while on H-1B? Yes in principle, because the NIW does not need an employer to file. It does not change your status. Ask an attorney.
Is a PhD required? No, but USCIS says a STEM PhD tied to a critical and emerging technology is an especially positive factor.
Does the NIW include a work permit? No. USCIS lists it as an immigrant petition. Work authorization comes with other status or filings.
