EB-2 NIW self-petition: how it works
US federal rules as of October 30, 2026. Sources re-checked against official pages on October 30, 2026. Where a figure could not be confirmed, this page links the official source instead of stating it.
The EB-2 National Interest Waiver (NIW) is a green card category in which the job offer and PERM labor certification are waived because your work is in the US national interest. Per USCIS, you may self-petition and file Form I-140 on your own behalf. You must first qualify for EB-2 and prove three things.
Who qualifies for EB-2?
An advanced degree (above a bachelor's, or a bachelor's plus five years of progressive experience) or "exceptional ability" in the sciences, arts or business.
What are the three NIW requirements?
- The proposed endeavour has substantial merit and national importance.
- You are well positioned to advance it.
- On balance, it benefits the US to waive the job offer and labor certification.
USCIS describes these three parts on its EB-2 page (checked 2026-10-30) and says it reviews the totality of the evidence.
What are the steps?
- Choose the category and gather evidence.
- File Form I-140. Your priority date is the date USCIS accepts it.
- Wait for a visa number in the Visa Bulletin.
- Adjust status (Form I-485) in the US or use consular processing.
Is self-petition fast?
No. You still wait for a visa number, which depends on country and category. See India green card backlog. Check the current dates in the Visa Bulletin; LiveRec does not copy them.
Mistakes to avoid
Recommendation letters that praise without explaining; an endeavour described too narrowly; "guaranteed approval" services.
What evidence does USCIS suggest for each prong?
| Prong | What USCIS filing tips say to show |
|---|---|
| 1. Substantial merit and national importance | A detailed description of the proposed endeavor and documents that show national importance. USCIS says "endeavor" is more specific than the general occupation, and that benefit to a specific employer alone is not enough. It must have broader implications for a field, a region or the public |
| 2. Well positioned to advance it | Your education, skills, knowledge and record of success in similar efforts; any detailed plan you developed; how you plan to pursue the endeavor; interest or support from customers, users, investors or others |
| 3. On balance, waive the job offer | Why a labor certification would be impractical, benefits to the US even if other US workers were available, and any urgency. USCIS says a national labor shortage alone does not satisfy this prong |
USCIS also says no single factor or piece of evidence establishes eligibility, and that it reviews the totality of the evidence.
What does the petition include?
A petition under the national interest waiver must be accompanied by a completed Form ETA-9089, Appendix A and a signed Form ETA-9089, Final Determination, according to the USCIS EB-2 page. You file Form I-140 yourself. The page lists no employer sponsor requirement for NIW petitions.
What are the EB-2 qualifications to document?
- Advanced degree professional: a US or foreign-equivalent degree above a bachelor's, or a bachelor's plus at least 5 years of progressive experience in the specialty, shown by official academic records and employer letters.
- Exceptional ability: expertise significantly above that ordinarily encountered in the sciences, arts or business, shown by at least 3 of the 6 listed criteria, such as an academic record, letters showing 10 years of full-time experience, a license, evidence of salary, membership in professional associations, or recognition by peers or government.
USCIS adds that qualifying experience must come after the degree and relate to the field of the degree or the proposed endeavor.
Step by step
- Write the endeavor in specific terms: the project, the field and who benefits.
- Collect proof you qualify for EB-2.
- Collect evidence for each prong, and independent support for any plan or letter.
- File Form I-140 and the supporting forms.
- Track your priority date in the Visa Bulletin.
Common mistakes
- Describing an occupation instead of an endeavor.
- Relying on employer benefit alone for national importance. USCIS says that is insufficient.
- Relying on a labor shortage alone for prong 3.
- Letters that praise without specific, first-hand examples, which USCIS says are more persuasive.
FAQ
Do I need an employer? No for NIW.
Can I use NIW without a PhD? An advanced degree or exceptional ability is needed.
Is a PhD required? No. USCIS says an advanced degree, particularly a PhD in a STEM field tied to the endeavor, is a positive factor. Exceptional ability or a bachelor's degree plus 5 years of progressive experience can also qualify for EB-2.
Do I need a job offer? USCIS says those seeking an NIW may self-petition and do not need a labor certification.
What does it cost? See the USCIS filing fees page. LiveRec states no fee.
