What is the definition of wages under the Labour Codes?

LiveRec EditorialUpdated

The wages definition in India's Code on Wages, 2019 says wages means all remuneration payable to an employee for work, with some listed components excluded. If those exclusions exceed 50 percent of total remuneration, the excess is added back to wages. The Ministry of Labour and Employment says the definition applies from 21 November 2025.

The 50 percent rule

The Ministry's FAQs say that where allowances and other excluded components exceed 50 percent of remuneration, the excess over 50 percent is added to the wage calculation. For the 50 percent test, statutory components such as the employer share of PF and pension contributions and statutory bonus are counted, while gratuity, ESI and other retirement benefits are not. Overtime allowance is also treated as part of the excluded components in that test.

Why it matters to you

The definition affects calculations tied to wages, including gratuity, and the Ministry states that the revised definition applies for gratuity calculation from 21 November 2025. It can change how a CTC is split between basic pay and allowances. It is different from minimum wages, which the appropriate government fixes, whereas wages are agreed between employer and employee.

Example

An employee's total remuneration is split so that excluded allowances are more than half of it. Under the rule, the amount above 50 percent is treated as wages, so the wage base for statutory calculations is higher than basic pay alone.
