H-1B vs L-1 India: key differences for professionals

LiveRec EditorialUpdated

US federal rules as of 31 October 2026. Sources re-checked against official pages on 30 October 2026. Where a figure could not be confirmed, this page links the official source instead of stating it.

An H-1B is for a specialty occupation with a US employer who registers and files for you. An L-1 is for an employee transferring within the same company group, such as from an office in India to a US office. Which one you can use depends on your employer, not on your preference.

What does USCIS say about L-1A?

  • The employer needs a qualifying relationship (parent, branch, subsidiary or affiliate) with the foreign company and must do business in the US and at least one other country.
  • You generally must have worked for the qualifying organization abroad for one continuous year within the three years before admission.
  • The initial stay is up to three years (one year for a new office), with extensions up to a maximum of seven years.
  • Blanket petitions let certain organizations establish the relationship in advance.

L-1B covers specialized knowledge workers; read the USCIS L-1B page for its rules.

Which is better for the green card?

Neither gives a green card on its own. Your employer must sponsor you. Indian-born applicants face the per-country wait in either case. See green card backlog and EB-2 vs EB-3.

What should I ask HR?

  1. Which visa will you file for me, and who pays for it?
  2. Does the company have a blanket L-1 approval?
  3. What happens to my status if I change employers? Read H-1B transfer.

Scam warning

See avoiding immigration scams and job scam safety for India. No one can sell you an H-1B, a lottery win or a green card place. Only the employer files an H-1B registration, and you never pay for it.

What does USCIS say about L-1B?

L-1B is for a professional with specialized knowledge. USCIS defines it as special knowledge of the organization's product, service, research, equipment, techniques, management or other interests and its application in international markets, or an advanced level of knowledge of its processes and procedures. The initial stay is up to three years (one year for a new office), with extensions in increments of up to two years and a maximum of five years.

For the H-1B limits, read H-1B from India. USCIS describes the H-1B as a visa for specialty occupations that needs a bachelor's degree or higher in the specific specialty, or its equivalent, and the cap process is on the USCIS cap season page.

What about the spouse?

H-4 spouses can work only in the cases USCIS lists. See H-4 EAD from India. USCIS says spouses of L-1 workers in valid L-2S status are employment authorized incident to status and do not need to file Form I-765 to work.

How do I choose?

  1. Ask HR whether the company has a qualifying foreign and US relationship and whether you have the one continuous year abroad.
  2. If yes, ask whether the company uses a blanket L-1 petition.
  3. If not, ask whether it will register you for the H-1B in March.
  4. Ask what happens if you change jobs. L-1 is tied to the corporate group; an H-1B can be moved with a new employer petition. See H-1B transfer.

Common mistakes

  • Treating the two as interchangeable. An L-1 employee cannot take a job with an unrelated US employer on the same petition.
  • Assuming L-1 avoids the green card queue. It does not; country limits still apply to Indian-born applicants.
  • Waiting for the lottery when you already qualify for an L-1.

FAQ

Can I switch from L-1 to H-1B? Yes in principle, but it is a new petition with its own rules and the lottery if cap-subject. Ask a licensed attorney.

Which one is faster to get? LiveRec states no processing times. Check USCIS case processing times and the US Embassy India appointment pages.

Does an L-1B qualify for a blanket petition? USCIS says the employee must also be a professional to use the blanket process.
