H-1B stamping in India: appointment waits

LiveRec EditorialUpdated

US federal rules as of 30 October 2026. Sources re-checked against official pages on 30 October 2026. Where a figure could not be confirmed, this page links the official source instead of stating it.

H-1B stamping is the visa interview at a US consulate in India after your petition is approved. Appointment availability and wait times change often and have varied widely. LiveRec does not quote a wait. Check the State Department's wait-time tool and the US Embassy India site on the day you plan.

What is stamping?

After USCIS approves the petition, you apply for the H-1B visa abroad; the visa foil is placed in your passport. An approval notice is not a visa.

What are the current wait times?

Check the State Department visa appointment wait times tool for Mumbai, Delhi, Hyderabad, Chennai and Kolkata on the day you plan. LiveRec publishes no figure because it changes.

How should I prepare?

  • Passport, I-797 approval notice, employer letter, pay stubs or offer, degrees and experience letters.
  • Complete the DS-160 and pay the visa fee. Check the current amount on the State Department visa fees page.
  • Book the earliest available slot; the State Department says applicants generally must apply in their country of nationality or usual residence (interview waiver update, 18 Sep 2025). Check the current rule for your case.

Is there a social-media or extra-screening step?

The State Department has published an announcement of expanded screening and vetting for visa applicants that covers H-1B and H-4 applicants. Read it for the current requirements and effective date; LiveRec does not summarise them here.

Who can help?

Your employer's attorney. Be wary of agents who sell appointments.

What does USCIS say happens after approval?

USCIS describes three steps. The employer or agent submits the Labor Condition Application to DOL, then Form I-129 to USCIS. If the petition is approved, a worker outside the US may apply with the State Department at a US Embassy or Consulate for an H-1B visa, if a visa is required. Whether or not a visa is required, the worker must then apply to US Customs and Border Protection (CBP) for admission in H-1B classification. Stamping is the visa step in the middle.

What is the difference between the approval notice, the visa and the I-94?

H-1B visaThe stamp in your passport that lets you apply to enterState Department, at a consulate
Form I-94Your arrival and departure record, with the "admit until" dateCBP, issued electronically at entry

CBP says foreign visitors no longer complete a paper I-94. You can retrieve your record on the CBP I-94 site, and you can print it from the site using "Get Most Recent I-94". Your I-94 date, not your visa date, is what governs how long you may stay.

Step by step for an Indian applicant

  1. Confirm with your employer's attorney that the petition is approved and which consulate you will use.
  2. Read the US Embassy India visa pages and the State Department wait-time tool for the current appointment rules.
  3. Complete the DS-160 and book the appointment on the official visa appointment system.
  4. Bring the passport, I-797 approval notice, employer letter and credentials, as your attorney advises.
  5. After entry, retrieve your I-94 and check the admit-until date matches your petition.
  6. Report any error on the I-94 to CBP, which lists deferred inspection sites for corrections.

Common mistakes

  • Booking through a site that is not the official appointment system. Appointments are not for sale. See avoiding immigration scams.
  • Assuming the interview waiver rules from a past year still apply. See the dropbox waiver.
  • Not checking the I-94 after arrival.
  • Traveling during a pending change of status or amendment without legal advice.

FAQ

Can I travel while the petition is pending? Depends on status. Ask your attorney.

Can I get a faster appointment? Emergency appointment rules are narrow. Check the embassy site.

Does the visa stamp show how long I can stay? No. The I-94 shows the admit-until date. The visa shows validity for applying to enter.

Who decides if I am admitted? A CBP officer at the port of entry. USCIS approval and a visa do not guarantee admission.

Can I change the consulate? The State Department sets that rule. Check the current page for your case.
